1. General Provisions
1.1 Introduction: By accessing and utilizing the services provided by AnsAtelier, hereinafter referred to as the "Company," you, the "Customer," agree to be bound by the following Terms and Conditions. These Terms constitute a legally binding agreement between the Customer and the Company.
1.2 Scope of Services: The Company specializes in creating custom artworks based on photographs provided by Customers. All transactions, communications, and disputes will be governed by the terms set forth herein.

2. Order and Acceptance
2.1 Order Submission: Customers may submit photographs and specific instructions via WhatsApp, email, or other methods as indicated on the Company’s website.
2.2 Order Review and Confirmation: Upon receipt of an order, the Company will review the submission for feasibility. The Company reserves the right to request additional information or clarification to proceed with the order.
2.3 Payment Terms: Full payment is required at the time of order placement. Accepted payment methods include Credit card, Debit Card, Bank Transfer, Paypal. The Company will not commence work on any order until payment is received in full.
2.4 Order Confirmation: An order is considered confirmed once payment is processed and the Customer receives an order confirmation email from the Company.
3. Production and Delivery
3.1 Production Timeline: Production times for custom artworks vary according to the style of the artwork and the season (e.g., on-season/off-season).
3.2 Shipping Terms: The Company offers free international shipping. Shipping costs are included in the price of the artwork.
3.3 Delivery Estimates: Estimated delivery times are provided at checkout and are subject to the carriers' terms and conditions. The Company is not liable for any delays caused by the shipping carrier or customs processes.
3.4 Customs and Duties: Customers are responsible for any customs duties, taxes, or fees imposed by their country. The Company advises Customers to check with their local customs office for more information.
4. Returns and Refunds
4.1 Final Sale Policy: Due to the personalized nature of custom artworks, all sales are final. The Company does not accept returns or provide refunds for custom orders.
4.2 Damage Claims: If the artwork arrives damaged, the Customer must notify the Company within 7 days of receipt, providing photographic evidence of the damage. The Company will assess the claim and, at its discretion, may offer a replacement or refund.
5. Intellectual Property Rights
5.1 Customer's Rights: The Customer retains all rights to the original photograph submitted.
5.2 License to Use: By submitting a photograph, the Customer grants the Company a non-exclusive, royalty-free license to create a custom artwork based on the photograph and to use images of the completed artwork for promotional purposes, including but not limited to, display on the Company's website and social media channels. Customers wishing to opt-out must notify the Company in writing.
6. Data Protection and Privacy
6.1 Data Collection: The Company collects personal information necessary to process and fulfill the Customer's order. This includes, but is not limited to, name, address, email, and payment information.
6.2 Data Usage: The Company does not share personal information with third parties except as necessary to fulfill the order (e.g., shipping providers) or as required by law. For further details, refer to the Company's Privacy Policy.
6.3 Compliance with GDPR: The Company complies with the General Data Protection Regulation (GDPR) applicable in Germany. Customers have the right to access, rectify, or delete their personal data, as well as the right to data portability and the right to lodge a complaint with a supervisory authority.
7. Dispute Resolution
7.1 Negotiation: Any disputes arising from these Terms and Conditions shall first be attempted to be resolved through mutual negotiation between the parties.
7.2 Arbitration: If a resolution cannot be reached through negotiation, the dispute shall be submitted to binding arbitration in accordance with the rules of the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit e.V. - DIS). The arbitration shall take place in Germany, and the language of arbitration shall be German.
8. Governing Law
8.1 Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law principles.
9. Amendments
9.1 Modification of Terms: The Company reserves the right to amend these Terms and Conditions at any time. Amendments will be posted on the Company's website, and the effective date will be updated accordingly. Customers are advised to review these Terms periodically to stay informed of any changes.
10. Acceptance of Terms
By placing an order with AnsAtelier, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions in their entirety.
